Terms of Service & End User License Agreement (EULA)

1. Acceptance of Terms & Apple EULA

These Terms of Service and End User License Agreement ("Agreement" or "Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Brooks Forsyth ("Developer", "we", "us", or "our"), regarding your download, installation, and use of the Reclaim AR application for iOS and iPadOS (the "App") and related web properties at reclaim-ar.com (the "Site").

Apple Standard EULA Incorporation: The App is made available through the Apple App Store as a Licensed Application. By downloading, accessing, or using the App, you explicitly acknowledge and agree that this Agreement incorporates and supplements the Apple Licensed Application End User License Agreement ("Standard EULA") published by Apple Inc. In the event of any conflict between this Agreement and the Standard EULA, the terms of this Agreement shall govern to the extent permitted by law, except where the Standard EULA provides superior protections for consumer privacy or Apple platform security.

If you do not agree with any provision of these Terms or the Apple Standard EULA, do not download, install, access, or use Reclaim AR.

2. Scope of License & Permitted Devices

The Developer grants you a non-transferable, non-exclusive, revocable, limited license to download, install, and execute Reclaim AR on any Apple-branded device running iOS 17.0 or later (including iPhone and iPad Pro devices) that you own or control, strictly as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

Family Sharing: Reclaim AR subscriptions and lifetime purchases support Apple Family Sharing where configured. When enabled, your subscription may be shared with members of your Apple Family Sharing group pursuant to Apple's Family Sharing rules and limitations.

You may not distribute, make available over a network where it could be used by multiple devices simultaneously, reverse engineer, decompile, disassemble, attempt to derive the source code of, modify, or create derivative works of Reclaim AR or any updates thereto.

3. Auto-Renewable Subscriptions & In-App Purchases

Reclaim AR provides optional premium features ("Reclaim AR Pro") available through auto-renewable in-app subscriptions and non-consumable one-time purchases, processed exclusively through Apple's In-App Purchase system and StoreKit 2 APIs.

*Prices are in U.S. Dollars and may vary in other countries or territories due to local taxes, currency conversion rates, and Apple App Store territory tiers.

Subscription Terms & Billing Mechanics

• Payment Charged to Apple ID: Payment will be charged to your Apple ID account at the confirmation of purchase, or immediately following the conclusion of any applicable free trial period.
• Automatic Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing cycle.
• Renewal Charges: Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current billing period at the rate specified for the active plan ($4.99 for Monthly Pro, or $19.99 for Annual Pro).
• Price Adjustments: Any proposed price changes will be communicated in advance via Apple's standard App Store notification protocols, requiring your affirmative agreement to continue the subscription at the new rate where mandated by Apple policy.

4. Free Trial & Renewal Conditions

The Annual Pro plan includes an introductory 7-Day Free Trial. The free trial allows full, unrestricted access to all Pro features—including unlimited LiDAR room sweeps, volumetric spatial tracking, continuous AI clutter detection, and 3D mesh exports.

• Trial Duration: The free trial begins immediately upon confirming your subscription selection in the App Store purchase dialog and lasts for exactly seven (7) days.
• Cancellation Before Trial Expiry: To avoid being charged the annual subscription fee of $19.99, you must cancel your subscription in your Apple ID Account Settings at least 24 hours before the 7-day trial period concludes.
• Forfeiture of Unused Trial: Any unused portion of a free trial period will be forfeited if you purchase a subscription to that publication or tier, where applicable.

5. Subscription Management & Cancellation

All subscriptions are managed directly by you through Apple's iOS subscription management interface. The Developer does not possess the technical or administrative capability to alter, renew, or cancel subscriptions on your behalf.

How to Cancel or Manage Your Subscription on iOS

1. Open the Settings app on your iPhone or iPad.
2. Tap your Name / Apple ID banner at the top of the screen.
3. Tap Subscriptions.
4. Select Reclaim AR from your list of active subscriptions.
5. Tap Cancel Subscription (or Cancel Free Trial) and confirm.

If you cancel, you will retain full access to Pro features until the end of your current paid billing period or trial duration, at which point the subscription will lapse and the App will revert to standard free features.

6. Refunds & Apple Media Services

Because all payments, transactions, and billing processing are executed by Apple Inc., all refund requests are subject to Apple's Media Services Terms and Conditions and must be submitted directly to Apple.

To request a refund for a Reclaim AR purchase:

1. Navigate to Apple's official refund portal at reportaproblem.apple.com.
2. Sign in with the Apple ID used to make the purchase.
3. Select "I'd like to...", choose "Request a refund", select Reclaim AR, and follow Apple's on-screen instructions.

The Developer cannot issue direct refunds or credit card chargebacks for purchases made through the App Store.

7. LiDAR, AR & Physical Safety Disclaimers

Reclaim AR uses Apple ARKit, device cameras, and LiDAR sensor telemetry to identify surface clutter, project augmented reality visual guides, and calculate estimated volumetric room clearance. While engineered for precision, AR visual overlays can temporarily distract or obscure real-world obstacles.

• Physical Awareness & Clear Pathways: Always remain fully aware of your physical surroundings while using Reclaim AR. Do not walk backwards, navigate staircases, or traverse uneven flooring while viewing your device screen.
• Organizational Guidance Only: All volumetric estimates, clearance metrics, and item priority recommendations are provided solely for organizational and decluttering guidance. They do not constitute structural engineering, architectural, or professional safety calculations.
• Hazardous Materials & Heavy Objects: Do not attempt to move heavy furniture, hazardous materials, damaged electrical wiring, or objects exceeding your physical capacity based on App prompts.
• No Emergency Use: Reclaim AR is not intended for use in building inspections, emergency egress planning, or structural remediation.

8. AI Vision Grounding & Ephemeral Processing

Reclaim AR leverages cloud AI multimodal vision inference (such as Google Gemini API and Groq API) to extract 2D coordinate bounding boxes from camera snapshots.

• Ephemeral Lifecycle: Snapshot frames captured during scans or verification checks are transmitted securely over TLS 1.3 to inference endpoints, processed in volatile memory, and never permanently retained or stored by Reclaim AR.
• Privacy Integration: All data practices conform to our Privacy Policy, which is incorporated by reference into these Terms. Reclaim AR does not sell user data or include third-party advertising SDKs.

9. User Restrictions & Acceptable Use

You agree not to:

• Use Reclaim AR for any unlawful, harassing, invasive, or unauthorized surveillance purposes.
• Capture images of individuals without their knowledge and consent.
• Attempt to bypass, disable, tamper with, or circumvent any security controls, licensing verification, or quota limits within the App.
• Use automated scripts, bots, or scraping tools against our companion API infrastructure.
• Resell, sublicense, rent, lease, or commercially distribute the App or its underlying models.

10. Intellectual Property Rights

The App, including its visual interfaces, RealityKit 3D shaders, frosted-glass overlay systems, algorithms, source code, logos, trademarks, and documentation, is the exclusive intellectual property of Brooks Forsyth and is protected by copyright, trademark, and other applicable intellectual property laws.

Apple, iPhone, iPad, iPadOS, ARKit, StoreKit, and LiDAR are trademarks of Apple Inc., registered in the U.S. and other countries and regions.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RECLAIM AR IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. THE DEVELOPER DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, ACCURACY, AND NON-INFRINGEMENT.

THE DEVELOPER DOES NOT WARRANT THAT THE OPERATION OF RECLAIM AR WILL BE UNINTERRUPTED, ERROR-FREE, COMPATIBLE WITH ALL FUTURE HARDWARE, OR THAT DEFECTS WILL BE CORRECTED IMMEDIATELY.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, INCIDENTAL, SPECIAL, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, DEVICE DAMAGE, TRIP-AND-FALL ACCIDENTS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE RECLAIM AR, HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE).

IN NO EVENT SHALL THE DEVELOPER'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER OR RELATING TO THIS AGREEMENT EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR RECLAIM AR DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR FIFTY U.S. DOLLARS ($50.00), WHICHEVER IS GREATER.

13. Indemnification

You agree to defend, indemnify, and hold harmless the Developer from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal and accounting fees) arising out of or in any way connected with your breach of these Terms, your misuse of the App, or your violation of any third-party rights or applicable laws.

14. Governing Law & Dispute Resolution

These Terms and your use of Reclaim AR shall be governed by and construed in accordance with the laws of the State of Texas, United States, excluding its conflict-of-law principles. Any legal action or proceeding arising under this Agreement shall be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction and venue therein.

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.

15. Modifications to These Terms

We reserve the right to revise, update, or modify these Terms at any time to reflect software enhancements, changes to legal requirements, or App Store guideline updates. The revised Terms will be posted on this page with an updated "Last Updated" date.

Continued use of Reclaim AR following the posting of modifications indicates your acceptance of the updated Terms. If you do not agree to the revisions, you must cease using the App and cancel any active subscriptions.
